Resumen
En esta primera parte podemos encontrar un planteamiento de los problemas que han surgido como consecuencia de la destrucción de los edificios (muchos de ellos organizados en régimen de propiedad horizontal). Se examinan separadamente las repercusiones en la configuración de los edificios (obras nuevas), en cuanto a la propiedad horizontal y a las cargas que afectan a los pisos y locales y, en particular, los problemas relativos a la extinción de la propiedad horizontal, la aparición de una situación de prehorizontalidad y el predominio de la copropiedad en esta fase, cuyos principios condicionan los actos de administración y disposición que los propietarios puedan llevar a cabo.
Abstract
In this first part we can find an approach about the problems arisen as aresult of the destruction of the buildings (many of them based on commonhold). Implications in the configuration of thebuildings are separately examined (new building works), with respect to the regulation of commonhold and the charges in relation of the apartments and, particularly, the problems relating to the extinction of the condominium, the presentation of a situation of pre-horizontality and the prevalence of the co-ownership during this stage, whose principles subdue those acts of administration or disposal which owners may carry out.
