Resumen
La nueva Ley de Arrendamientos Rústicos 26/2005, de 30 de noviembre, reintroduce los derechos de tanteo y retracto que habían sido suprimidos por Ley 49/2003, de 26 de noviembre.
Vamos a analizar la evolución doctrinal de estos derechos, analizando sus requisitos, su tratamiento registral y su reflejo jurisprudencial a lo largo de los años.
Abstract
Act 26/2005 of 30 November, the new urban lease act, reintroduces prospective and retrospective rights of first refusal, which had been eliminated by Act 49/2003 of 26 November. We are going to analyse the doctrinal evolution of these rights, analysing their requirements, their handling in registration and their reflection in case law throughout the years.
