Resumen
Los cambios jurisprudenciales a los que nos hemos visto sometidos en los últimos meses acerca de a quién corresponde el pago del impuesto de actos Jurídicos documentados ha generado gran inquietud, no solo a nivel jurídico, si no sobre todo financiero.La STS de 16 de octubre de 2018 ha modificado el criterio jurisprudencial existente hasta ahora sobre quién es el sujeto pasivo, y por tanto, obligado, a pagar el impuesto sobre actos jurídicos documentados (iaJd) al que se ve sometido el otorgamiento de escritura pública para la constitución de la hipoteca que garantiza el préstamo hipotecario. Se pretende en este trabajo poner de relieve quién resulta beneficiado por la constitución de la garantía hipotecaria, cuáles son sus ventajas y qué supone o aporta el que exista la garantía real en un préstamo frente a aquellos préstamos que carecen de ella. no pretendemos analizar desde el punto de vista de la técnica jurídica tributaria quién es realmente el sujeto gravado sino, solo, ofrecer desde la perspectiva civil, las cualidades o beneficios que ofrece la hipoteca y a quién se los otorga, así como analizar la naturaleza del acto que se grava, por si puede servir, partiendo de esa base, para replantearse quién debería pagar entonces el impuesto AJD conforme al artículo 68.2 reglamento del impuesto sobre Transmisiones Patrimoniales y actos Jurídicos documentados.
Abstract
The jurisprudential changes that we have been subjected in recent months about who owes the payment of the Tax on Documented Legal Acts has generated great concern, not only at a legal level, but above all financially. The judg- ment of October 16, 2018 has modified the existing jurisprudential criterion about who is the taxpayer of the tax on documented legal acts (IAJD) in a mortgage loan. The purpose of this paper is to highlight who is benefited by the constitution of the mortgage guarantee, what are its advantages and what does the real guarantee in a loan entail or contribute to, compared to loans that lack it. We do not intend to analyze from the point of view of tax legal technique who is really the taxable subject but, only, offer from the civil perspective, the qualities or benefits offered by the mortgage and to whom it is granted, as well as analyze the nature of the act that is taxed, in case it can be used, starting from that base, to rethink who should pay then the AJD tax in accordance with art 68.2 Regulation of Transfer Tax and Documented Legal Acts.
