PROBLEMÁTICA DE LA PARTICIÓN POR CAUSANTE.

Resumen
La partición hecha por el propio causante (testador) es una práctica muy eficaz y conveniente, ya que permite al testador realizar la distribución de sus bienes entre sus herederos sin necesidad de recurrir a la intervención, a veces larga, tediosa e incluso costosa, de los contadores partidores. No es, sin embargo, una práctica muy frecuente en nuestro país. La partición practicada por el propio testador puede realizarse por acto entre vivos o mortis causa, pero ha de fijar siempre la porción de herencia que ha de recibir cada heredero. Hay que tener en cuenta que no habrá partición efectuada por el testador cuando este se limite a señalar las directrices que desea se siga en orden a la partición propiamente dicha, o cuando los bienes que asigna lo son a cuenta de la participación de los herederos, pero no en pago íntegro de su cuota, tal como señalaron las sentencias del Tribunal Supremo, de 9 de marzo de 1961 y 15 de febrero de 1988. La base de la partición hecha por el testador se fundamenta en que la voluntad del causante es la ley fundamental de la sucesión, y se regula este modo de practicar la partición en el artículo 1056 de nuestro Código Civil, estableciendo que se pasará por ella en cuanto no perjudique la legítima de los herederos forzosos. Esta partición ha de concretarse a los bienes del testador -art. 156.1 del CC-.
Abstract
Partition by the predecessor in title (testator) is a highly effective, convenient practice, because it allows the testator to distribute his or her property among the heirs without the need to engage in the long, tedious and even costly process of bringing in an auditor to handle the partition. It is not, however, a very frequent practice in Spain. Partition by the selfsame testator can be done in the form of an inter-vivos act or a mortis-causa act, but the portion of the estate that each heir is to receive must always be specified. Partition by the testator does not mean that the testator merely states the guidelines he or she wishes followed during the actual partition; nor does it mean the distribution of properties as a «payment on account» of the heirs' share in the estate but not in full payment of the heirs' share, as indicated by the Supreme Court's rulings of 9 March 1961 and 15 February 1988. The basis of a partition performed by the testator is that the wishes of the predecessor in title are the fundamental law of succession. This mode of performing partitions is regulated in article 1056 of the Spanish Civil Code, which states that partitions may be conducted by the testator when the fixed portions to which certain heirs are entitled by law are not thereby injured. This partition must be restricted to the testator's property (Civil Code, article 1056.1).
