Resumen
La fianza puede ser un contrato pactado entre el garante y el acreedor -contrato típico del que nace la obligación fideusoria disciplinada en el Código Civil-, pero también puede ser una descripción de la obligación fideusoria del garante, cuya fuente no se halla en el contrato típico de fianza, como sucede en la solidaridad pasiva, en el mandato de crédito, en el seguro de caución, en la comisión de garantía o en el endoso.
Abstract
A deposit can be a contract between the guarantor and the lender (the type of contract which gives rise to the deposit obligations addressed in the Civil Code), but a deposit can also be a description of the guarantor's deposit obligation, whose source does not lie in a deposit contract. This happens in several liability, orders for credit, surety bonds, guarantee commissions and endorsements.
