Resumen
Este informe tiene por objeto demostrar que el artículo 36 del nuevo Reglamento General de Costas (RGC/2014), aprobado por Real Decreto 876/2014, de 10 de octubre, en cuanto cierra o condiciona el acceso al Registro de la Propiedad de toda inscripción, anotación, cancelación o nota marginal que deba extenderse en el folio de fincas previamente inmatriculadas, es incompatible con la legislación civil, en particular la registral, española y carece de la cobertura de la Ley de Costas, por lo que no puede ser aplicado sin grave menoscabo de la calidad del sistema registral español.
Abstract
This report aims to demonstrate that article 36 of the new National Coast Regulation approved by Royal Decree 876/2014 of 10 October is illegal, because it bars or restricts registration for all entries, caveats, cancel- lations and marginal notes that should be set down on the folio for properties that have previously undergone initial registration; because it is incompatible with civil law, particularly registration law; and because it is not covered by the Coast Act. Therefore, it cannot be applied without serious detriment to the quality of the Spanish registration system.
