Resumen
El artículo 139.2 de la LRJPAC estableció los requisitos que han de concurrir para que el daño alegado sea indemnizable:
«En todo caso, el daño alegado habrá de ser efectivo, evaluable económicamente e individualizado con relación a una persona o grupo de personas».
En este artículo me refiero a estos requisitos del daño y entro en el análisis de un supuesto práctico muy interesante, que tuve ocasión de estudiar con motivo de mi trayectoria profesional y especialización en este ámbito.
Abstract
Article 139.2 of the Act on the Legal Framework for Public Administrations and the Common Administrative Procedure established the requirements that must be met in order for alleged damage to be indemnifiable:
«At all events the alleged damage shall have to be actual, economically evaluable and individualised in connection with a person or group of persons».
This article refers to the said requirements for damage and enters into an analysis of a very interesting practical case that the author had the occasion to study during her professional career and specialisation in this field.
