Resumen
Nuevamente el TJUE se ha pronunciado en relación con el Derecho español y las cláusulas abusivas. En este caso se ha tratado de la cláusula de gastos hipotecarios. En este trabajo se analizará la doctrina desarrollada por el TJUE en su sentencia de 16 de julio de 2020, que viene a avalar la doctrina del Tribunal Supremo permitiendo la integración del contrato con el Derecho supletorio nacional. Se comentará críticamente esta doctrina junto con los distintos criterios fijados por el Tribunal Supremo sobre la distribución de los gastos hipotecarios entre las partes y que tanta polémica y controversia ha suscitado en los últimos años. Junto con ello, brevemente se analizarán también las cuestiones también abordadas por el TJUE acerca del plazo de prescripción de la acción de restitución de cantidades indebidamente abonadas a raíz de la declaración como abusiva y nula de una cláusula contractual, y sobre la imposición de las costas procesales al prestamista como mecanismo para evitar disuadir al consumidor de la defensa de sus derechos, pero, no obstante, para asimismo disuadir al prestamista del uso de cláusulas abusivas.
Abstract
Again the CJEU has ruled in relation to Spanish law and abusive clauses. In this case it has been the mortgage expense clause. This work will analyze the doctrine developed by the CJEU in its judgment of July 16, 2020, which endorses the doctrine of the Supreme Court allowing the integration of the contract with national supplementary law. This doctrine will be critically commented on along with the different criteria set by the Supreme Court on the distribution of mortgage expenses among the parties and that has caused so much controversy and controversy in recent years. Along with this, the issues also addressed by the CJEU about the limitation period of the action for restitution of amounts unduly paid as a result of the declaration as abusive and null of a contractual clause, and on the imposition of costs to the lender as a mechanism to avoid dissuading the consumer from defending their rights, but nonetheless to also dissuade the lender from the use of abusive clauses.
