Resumen
El fuerte crecimiento urbanístico vivido en España en el último decenio ha puesto de relieve ciertas disfunciones en los procesos urbanizadores que exigen la opción por nuevas alternativas que, sin estar expresamente contempladas en la Ley, tienen sin embargo una clara respuesta en ella mediante la creación de fórmulas que, garantizando en todo caso los derechos de los afectados y con las garantías ofrecidas por el sistema registral para garantizar la oponibilidad a terceros, posibiliten al tiempo la correcta ejecución del planeamiento urbanístico.
Abstract
The strong growth in development Spain has experienced over the last ten years has thrown into relief certain dysfunctions in development processes that require the option of new alternatives. These new alternatives, although not expressly envisioned in Spanish legislation, find however in legislation a clear response, by means of the creation of formulae that, while guaranteeing at all events the rights of the persons involved, with the guarantees offered by the registration system to ensure third-party enforceability, at the same time make the correct execution of city planning possible.
