Resumen
Este trabajo aborda el estudio de las condiciones generales abusivas en la contratación inmobiliaria así como las vías para combatirlas. Nuestro Ordenamiento Jurídico ofrece varios remedios contra ellas, como son las acciones colectivas y por supuestos las acciones generales individuales de nulidad contractual. Pero también ofrece la colaboración de notarios y registradores de la propiedad en el control de la legalidad inmobiliaria. Otro fundamental instrumento es la Comisión Asesora en materia de control de cláusulas abusivas impulsada por el Instituto Nacional de Consumo y que llevó a la aprobación de un modelo orientativo de contrato de compraventa de vivienda sin cláusulas abusivas, que se incorpora como anexo.
Abstract
This paper conducts a study of abusive general conditions in real estate contracts and the channels for combating such conditions. Our legislation offers a number of types of redress, such as collective action and of course individual general action for contract nullity. But it also offers cooperation between notaries and property registrars in supervising the legality of real-estate transactions. Another fundamental instrument is the Advisory Committee on the supervision of abusive clauses, promoted by the National Consumer Institute, which led to the approval of an orientative standard housing-purchase contract that is free of abusive clauses, and is incorporated as an appendix to this paper.
