Resumen
Este estudio examina la competencia judicial internacional en materia de seguros de la Sección 3.ª del Reglamento 44/2001, de 22 de diciembre de 2000. Dicha Sección contempla diferentes foros cuyo objetivo es la protección de la parte débil (tomador, asegurado o beneficiario). Cabe la posibilidad de que las partes se sometan a otros tribunales, si bien sólo se permite una autonomía limitada para elegir el tribunal competente en los contratos de seguro. Por ejemplo, en caso de que la sumisión permita a la parte débil formular demandas ante tribunales distintos de los indicados en la citada Sección.
Abstract
This study deals with jurisdiction in matters relating to insurance (Section 3, Council Regulation, núm. 44/2001 of 22 December 2000). That Section establishes different rules of jurisdiction aimed at protecting the weaker party (the policyholder, the insured or a beneficiary). The provisions of this Section may be departed from by an agreement, but only limited autonomy to determine the courts having jurisdiction is allowed in insurance contracts. For instance, when it allows the weaker party to bring proceedings in courts other than those indicated in that Section.
