Resumen
No resulta fácil saber las razones que indujeron a los codificadores a introducir la regla que en el Código Civil español aparece en el párrafo segundo del artículo 1.468, que atribuye al comprador los frutos de la cosa vendida desde el momento en que se perfeccionó el contrato.
Algunos sectores doctrinales han pretendido que la regla se encuentre en conexión con el tipo de compraventa que los Códigos quisieron delinear y, en especial, con el carácter traslativo que a partir de la codificación francesa la compraventa adoptó en dicha codificación y en las que siguieron sus huellas. El autor del trabajo sostiene que la regla del párrafo segundo del artículo 1.468 es de origen romano, concordaba perfectamente con la compraventa romana y tiene su fundamento en una forma de compensación al comprador de las atribuciones de los riesgos de acuerdo con el principio de periculum est emptori.
Abstract
It is not easy to know what reasons led lawmakers to introduce the rule appearing in the second paragraph of article 1,468 of the Spanish Civil Code, which gives the buyer the fruits of the purchased thing as of the moment when the contract of sale is concluded. Some sectors of doctrine have claimed that the rule is connected with the type of purchase that such codes were meant to delineate and, more especially, the transferential nature of purchases under the French Civil Code and all civil codes cast in its mould. The author of this article sustains that the rule in the second paragraph of article 1,468 is of Roman origin, is in perfect concordance with purchases under Roman law and is at base a form of buyer's compensation for risks assigned, under the rule of periculum est emptori.
