Resumen
En la sentencia del Tribunal Supremo de 25 abril de 2014 se analiza si la obligación de entrega de los frutos nace en todo caso desde la perfección de la venta o bien desde la exigibilidad de dicha obligación, realizando una interpretación de los artículos 1095 y 1468 del Código Civil desde las instituciones de la exceptio non adimpleti contractus y de la mora credendi.
Abstract
The Supreme Court's ruling of 25 April 2014 concerns whether the obligation to deliver the fruits begins at the conclusion of the sale or at the point when the obligation becomes payable. The Supreme Court interprets articles 1095 and 1468 of the Civil Code from the standpoints of the institutions of exceptio non adimpleti contractus and mora credendi.
