Resumen
El presente estudio analiza la regulación correspondiente a los derechos reales de adquisición de constitución voluntaria, integrada en el título XI del libro III de la Propuesta de Código civil elaborada por la Asociación de Profesores de Derecho Civil. En la Propuesta se asume el reto de ofrecer una regulación sistemática, coherente y que dé respuesta a los problemas que plantea en la práctica una categoría de derechos que carece de ella en el Código civil y que es objeto de viva polémica doctrinal sobre no pocas cuestiones. Parte de la convicción, basada en circunstancias objetivamente constatables, de que los derechos de adquisición mantienen su vitalidad y desempeñan en la actualidad una función importante en el tráfico jurídico.
Abstract
This paper studies the regulation of the preferential rights in the acquisition of property voluntarily created included in Book III, Title III, of the Proposal of Civil Code produced by the Association of Civil Law Professors. The Proposal accepts the challenge to provide a systematic, coherent and effective regulation for a category of rights where currently none exists in the Civil Code. That category of rights is highly polemic. The Proposal starts from the belief, based in objectively-identified circumstances, that these rights retain their vitality, having an important role for legal transactions today.
