Resumen
La ratificación por España de la Convención de Naciones Unidas para los derechos de las personas con discapacidad implica la necesidad de adaptar nuestro Derecho interno. En concreto, el Derecho civil debe adaptarse al ya conocido art. 12 de la Convención. La doctrina suele centrar su atención en la acomodación del Código civil, pero no debe olvidarse que la obligación de reconsiderar la regulación existente incumbe tanto al legislador estatal como, en su caso, a los legisladores territoriales. El presente artículo estudia la adaptación de los Derechos civiles en España: del Código civil y de los derechos civiles territoriales, con especial referencia al Derecho civil aragonés. Y analiza la posible incidencia de la reforma del ordenamiento jurídico privado estatal en la adaptación de las normas aragonesas como consecuencia de los problemas de armonización que, de otra forma, podrían llegar a existir.
Abstract
Spain’s ratification of the United Nations Convention on the Rights of Persons with Disabilities implies the need to adapt our internal law. In particular, civil law must be adapted to the well-known art. 12 of the Convention. The doctrine tends to focus its attention on the accommodation of the Civil Code, but it must be taken into account that the obligation to reconsider the existing regulation lies both with the State legislator and, where appropriate, with the territorial legislators. This research examines the adaptation of civil rights in Spain: the Civil Code and territorial civil rights, with special reference to Aragonese civil law. It also addresses the potential impact of the reform of the state private legal system on the adaptation of the Aragonese norms as a consequence of the problems of harmonization that might otherwise exist.
