LOS ALIMENTOS DE LOS HIJOS MAYORES DE EDAD Y EMANCIPADOS. A PROPÓSITO DEL ARTÍCULO 93.2 DEL CÓDIGO CIVIL.

Resumen
La mayoría de edad no supone la extinción automática de los alimentos a favor de los hijos cuando alcanzan dicha edad, pues constituye hoy una realidad la prolongación de sus estudios más allá de la misma, además de las dificultades de acceso a un empleo que determinan que constante matrimonio tales alimentos formen parte de las cargas familiares o del matrimonio, y una vez tiene lugar la crisis conyugal, puedan solicitarse como pensión de alimentos en el seno del propio procedimiento matrimonial, siempre que concurran los requisitos contenidos en el artículo 93.2 del Código Civil, concediendo legitimación para solicitarlos al progenitor conviviente. Sobre tales bases, en el presente estudio vamos a analizar el régimen jurídico de los alimentos de los hijos mayores de edad, tanto en sus aspectos sustantivos como procesales, haciendo referencia para ello a las diferentes aportaciones doctrinales y jurisprudenciales existentes en relación con la materia.
Abstract
The adult age does not suppose the automatic extinction of the food in favour of the children when they reach the above mentioned age, so, a reality constitutes today the prolongation of his studies beyond the same one, besides the difficulties of access to an employment that determine that constant marriage such food forms a part of the familiar loads or of the marriage, and once the conjugal crisis takes place, could be requested as alimony in the bosom of the own matrimonial procedure, providing that they meet requirements contained in the article 93.2 of the Civil Code, granting legitimization to request them the coexistent progenitor. On such bases, in the present study we are going to analyze the juridical regime of the food of the major children of age so much in his substantive as procedural aspects referring for it to the different doctrinal and jurisprudential existing contributions in relation with the matter.
