Resumen
Las decisiones y los acuerdos de la junta de propietarios en un edificio en régimen de propiedad horizontal son siempre un nido de conflictos. Cuando los mismos afectan a la alteración de elementos comunes o la instalación de nuevos de ellos, con un coste elevado que se repercute en las cuotas, todavía más. Vamos a analizar en este trabajo la jurisprudencia más reciente en torno a unos acuerdos concretos: aquellos relativos a la instalación de una piscina en zona común, con los problemas derivados de su uso y pago de cuotas. Se pretende poner de relieve los aspectos más importantes y problemáticos que la jurisprudencia ha recogido al respecto.
Abstract
The decisions and agreements of the Board of Owners in a building on a horizontal property regime are always a nest of conflicts. When they affect the alteration of common elements or the installation of new elements, with a high cost that affects fees, even more. We are going to analyze in this paper the most recent jurisprudence around specific agreements: those related to the installation of a pool in a common area, with the problems derived from its use and payment of fees. It is intended to highlight the most important and problematic aspects that jurisprudence has collected in this regard.
