Resumen
Continuando con el propósito de intentar elaborar una interpretación evolutiva de la Ley 13/2015 y su repercusión sobre los principios hipotecarios, nos ocupamos, en este tercer artículo de la serie, en indagar sobre las repercusiones geográficas del principio de inscripción, entendido este como el que trata del papel de la inscripción en la constitución, transmisión, modificación y extinción de derechos reales. Nos vamos a plantear cuál es el valor de la incorporación de la georreferenciación a la inscripción respecto a la descripción de la finca, que es objeto de inscripción; cuando se incorpora la georreferenciación de la finca al asiento; y, finalmente, cuales son los efectos que produce.
Abstract
Continuing with the purpose of trying to develop an evolutive interpretation of Law 13/2015 and its repercussion on mortgage principles, we deal in this third article of the series, in inquiring about the geographical repercussions that it has on the principle of registration, understood as the one dealing with the role of registration in the constitution, transmission, modification and extinction of real rights. We are going to consider the value of the incorporation of the georeferencing to the inscription, with respect to the description of the farm, which is the object of registration, when the georeferencing of the farm is incorporated into the seat and, finally, what are the effects what it produces.
