Resumen
Se pretende diferenciar las prohibiciones de disponer de las obligaciones de no disponer en cuanto a su esencia y oponibilidad erga omnes, y su consecuente inscripción en el Registro de la Propiedad. Igualmente, se analizan las causas de su no inscripción cuando están incluidas en un contrato de préstamo hipotecario.
Abstract
This paper endeavours to differentiate prohibitions of disposal from obligations of non-disposal, in terms of their essence and erga omnes enforceability and in terms of their consequential registration in the Property Registry. It also analyses the causes of non-registration when such prohibitions are included in mortgage loan agreements.
