Resumen
Las condiciones imposibles y las contrarias a las leyes o a las buenas costumbres se tendrán por no puestas lo que plantea la cuestión acerca de si caben cualquier tipo de condiciones que coarten la libertad del instituido con tal de que no sean contrarias a la ley o a las buenas costumbres. En este punto la libertad para testar puede entrar en colisión con los derechos y libertades fundamentales. No hallamos ante la cuestión de la drittwirkung, de la eficacia inter privatos de los derechos fundamentales. En este trabajo se trata también de las condiciones potestativas de hechos pasados, normalmente la condición de que los herederos instituidos cuiden al testador hasta su fallecimiento, que no siempre es fácil diferenciar de otro elemento accidental del negocio jurídico testamentario cual es el modo.
Abstract
