Resumen
El crédito hipotecario se constituye en una figura económica y jurídica que, manifiestamente, ha sido cimiento del progreso económico y social de las últimas décadas. La doctrina legal y la doctrina científica han sido profusas en el análisis de su tratamiento legislativo, aunque centrándose básicamente en el elemento principal del mecanismo, situándose a su sombra la garantía hipotecaria constituida por bienes inmuebles que, desde su constitución hasta la eventual ejecución, continúan en el tráfico económico y social con las alteraciones materiales y jurídicas que su conservación y aprovechamiento pueda generar. Este aspecto dinámico también se somete a los criterios legales y, esencialmente, a la convención de las partes mediante cláusulas de extensión objetiva que plantean cuestiones relativas a su fundamento primordial y alcance práctico.
Abstract
Mortgage credit is an economic and legal figure that has undoubtedly been the foundation of the economic and social progress of the last decades. Legal and scientific doctrine have been abundant in the analysis of their legislative treatment, although basically focusing on the principal element of the mechanism. The mortgage guarantee constituted by real estate is the accessory element that, from its constitution until its eventual execution, continues in the economic and social traffic with the material and legal alterations that its conservation and exploitation can generate. This dynamic aspect is governed by legal criteria and, mainly, by the agreement of the parties through clauses of objective extension, which raise issues related to their fundamental foundation and practical scope.
