LA UNIFICACIÓN DEL DERECHO PRIVADO EUROPEO EN EL ÁMBITO CONTRACTUAL Y LA POSIBILIDAD DE AMPLIACIÓN A LA PROPIEDAD INMOBILIARIA.

Resumen
Las propuestas unificadoras o armonizadoras del Derecho Privado europeo se han centrado, esencialmente hasta ahora, en el ámbito del Derecho de Contratos. Sin embargo, la necesidad de incluir los efectos jurídico-reales de las relaciones obligatorias se ha hecho patente ante los problemas de seguridad jurídica que su no consideración podrían provocar, sobre todo en materia de transmisión de propiedad. Por ello, son ya numerosas las voces, que a instancia, también, de las instituciones europeas, proponen la necesidad de ampliar un poco más el contenido del Marco Común de Referencia, a la vista de los argumentos e iniciativas, en este sentido, de investigadores y estudiosos de la materia. Se hace, por tanto, indispensable incluir el Derecho de Propiedad, tanto de bienes muebles como de inmuebles, y, sobre todo, el modo y efectos de su transmisión, aun conscientes de los diferentes sistemas de transmisión vigentes en los estados miembros de la Unión Europea. Pero una mirada al origen histórico de las reglas de transmisión de la propiedad y a los efectos reales en la práctica actual de cada ordenamiento jurídico, en aras de la seguridad jurídica, podría facilitar un punto de encuentro para conseguir la unificación.
Abstract
The purposes of harmonisation or unification European Private Law have focused essentitlly in the area of Contracts Law. However, the need to include the reals legals effects of obligatory relation it has become apparent to the problems of legal certainty that its failure could result, especially in the field of transfer of property. Therefore, many voices are now, at which also the European institutions, suggest the need to expand a bit more content Common Frame of Reference, in the light of the arguments and initiatives in this respect of researchers and studiouses in the field. It is therefore essential to include the property right, both movables and immovables, and especially the legal model and purposes of its transfer, even aware of the various transferability systems in force in member states of the Union Europe. But a look at the historical origins of the rules on the transfer of property and real effects in the current practice of law for procure of legal certainty, it could facilitate a meeting point for unification.
