Resumen
En este trabajo se pretende hacer un repaso sobre las peculiaridades de la tradición instrumental, puestas de relieve por la jurisprudencia, que ponen de manifiesto sus divergencias con la tradición real, y configuran este especial modo de tradición ficticia en nuestro sistema de transmisión de los derechos reales.
Abstract
This paper endeavours to give a review of the special features of delivery of ownership through document transfer, as highlighted by case law, which show clearly how delivery through document transfer differs from actual delivery, and how this special mode of fictitious delivery is configured in our system for the conveyancing of real rights.
