Resumen
Los bienes gananciales responden por las deudas contraídas en el ejercicio del comercio tal como establece el artículo 1365.2 del Código Civil que, remite al Código de Comercio, dotando para ello de un régimen específico. el presente estudio se va a centrar precisamente en la responsabilidad de los bienes gananciales ante las deudas comerciales, a la posición jurídica del cónyuge no comerciante, a su posible consideración o no como consumidor y, en consecuencia, a la aplicabilidad o no de los controles de abusividad y transparencia en los contratos de préstamo o crédito hipotecarios suscritos por el cónyuge comerciante y en cómo se sustancian tales controles de resultar operativos.
Abstract
The joint property answers of the carried away debts in the exercise if the trade as there establishes the article 1265.2 of the civil code that the sends to the code of trade, providing for it with a specific regime. The present study is going to centre precisely on the responsibility of the join property to the juridical position if the spouse not merchant, to his possible consideration or not as consumer and in consequences to the applicability or not of the controls of transparency in the contracts of martgage lending signed by the spouse merchant and in since such controled develop.
