Resumen
La institución de la responsabilidad civil reviste un especial interés cuando viene referida al mundo de las residencias asistenciales, y ello porque en estos centros se desarrollan cada vez más actividades con el fin de prestar el mejor servicio posible a sus usuarios, como el alojamiento, alimentación, ayuda a la movilidad, y en muchos casos también servicios asistenciales y sanitarios. Por lo tanto, el ámbito en el que se puede causar daños es cada vez mayor.
El objetivo de este trabajo es, en primer lugar, el de determinar el tipo de contrato existente en estos supuestos, y el régimen de derechos y deberes propios del mismo, a la vista de la ausencia de regulación genérica de la relación establecimiento residencial/usuario del mismo que caracteriza al sistema español.
Y en segundo lugar, a la vista de la calificación de contrato de hospedaje que se utiliza en algunas disposiciones normativas para referirse al acuerdo de ingreso en un centro residencial, el de determinar si es aplicable a este tipo de relación la responsabilidad especialmente agravada de los centros hoteleros con respecto a los objetos introducidos por los clientes en su establecimiento que consagra el Código Civil español.
Abstract
One especially interesting topic is civil liability in the context of the world of care homes. That is because care homes are conducting more and more activities in order to provide the best possible service for their users; these activities include accommodations, nutrition, assistance for the mobility-impaired and often care-giving and health services. Therefore the realm in which care homes can do harm is becoming larger and larger.
The objective of this article is, firstly, to determine what kind of contract there is in these cases, and what system of rights and duties corresponds to that contract, in view of the Spanish system's lack of any generic regulations on the home/user relationship.
And secondly, in view of the fact that some legislation classifies the agreement to intern persons in a care home as a lodging contract, this article seeks to determine whether the especially aggravated liability of hotels for objects introduced in their establishment by their guests under the Spanish Civil Code is applicable to this type of relationship.
