Resumen
El ejercicio de la facultad de uso y disfrute del derecho de propiedad en un entorno saludable, está interrelacionado con el «derecho a disfrutar de un medio ambiente adecuado para el desarrollo de la persona» (art. 45 CE).
El Derecho Privado ofrece para su tutela acciones que derivan de los derechos reales y de responsabilidad civil extracontractual por daños a intereses generales. Aunque el medio ambiente se regula profusamente por el Derecho Administrativo, la jurisdicción civil resulta también competente para conocer de los supuestos que, afectando directamente al medio ambiente, vulneren derechos subjetivos de particulares. El Derecho Civil ofrece acciones, ejercitables individual y colectivamente, en el ámbito de las relaciones de vecindad (inmisiones), responsabilidad civil, abuso del derecho, que deben contemplar las soluciones aportadas por el Derecho comparado, incluyendo las Directivas de la Unión Europea y los proyectos de Unificación del Derecho Privado Europeo.
Abstract
The exercise of the right of use and enjoyment of property rights in a healthy environment, is intertwined with the «right to enjoy an environment suitable for the development of the person» (article 45 SC).
Private Law provides for protection actions arising from property rights and tort liability for damages to general interests. Although the environment is heavily regulated by Administrative Law, civil jurisdiction is also competent to decide cases that directly affect the environment, violate individual rights of individuals. Civil Law provides actions, exercisable individually and collectively, in the field of neighborhood relations (immissions), liability, abuse of rights, which should consider the solutions provided by comparative law, including the directives of the European Union and the Draft European Private Law Unification.
