Resumen
Desde una perspectiva esencialmente práctica, son evidentes los problemas que plantea la reparación de la terraza del ático para la comunidad de propietarios. Suele ser frecuente que este elemento común tenga atribuido su uso exclusivo al propietario del ático que tiene acceso directo a la terraza. Los tipos posibles de reparaciones y la forma de proceder al pago de los gastos que las mismas originan constituyen la finalidad de este trabajo. Se presta especial atención a la distinción entre reparaciones ordinarias y extraordinarias, formulando observaciones críticas al planteamiento tradicional, ya que la solución debería tener en cuenta criterios que proporciona la técnica constructiva. Otros temas abordados son el plazo para el ejercicio de la acción y el acceso a la terraza para proceder a la reparación.
Abstract
From an essentially practical perspective, there are evident problems for the owners' community, stated by the repair of the attic terrace. It is frequent that this common element has the exclusive use attribued to the owner of the attic who has direct access to the terrace. Possible types of repairs and how to proceed with payment of the expenses that they originate constitute the purpose of this paper. Special attention to the distinction between ordinary and extraordinary repairs, formulating critical observations to the traditional approach, since the solution should take into account criteria that provide the construction technique. Other topics include the term for the exercise of the action, and the access to the terrace to proceed to the repair.
