Resumen
El pasado 30 de enero de 2020 el Abogado General Saugmandsgaard Øe publicó sus Conclusiones sobre la cuestión prejudicial formulada por el Juzgado de Primera Instancia núm. 3 de Teruel acerca de si es posible negociar sobre una cláusula que puede ser abusiva, y renunciar a invocar su abusividad. El artículo 6.1 de la Directiva 93/13/EEC de 5 de abril de 1993, sobre las cláusulas abusivas en los contratos con consumidores, impone que esta estipulación no vinculará al consumidor. Sin embargo, y no existiendo prohibición expresa en la Directiva, el acuerdo transaccional, admitido por la STS de 11 de abril de 2018, la Comunicación de la Comisión Europea de 27 de septiembre de 2019, y las Conclusiones del Abogado General, permiten al consumidor el acuerdo transaccional para evitar enjuiciar una posible abusividad.
Abstract
On january, 30, 2020, the Advocate General Saugmandsgaard Øe published his Conclusions regarding the reference for a preliminary ruling issued by the Court of First Instance num. 3 of Teruel, about whether it is possible to negotiate on a clause that can be abusie, and give up invoking its abuse. Article 6.1 of the Directive 93/13/EEC of 5 April 1993 on unfair terms in consumer contracts requires that these clause are not binding on the consumer. However, and in the absence of express prohibition in the Directive, the transactional agreement, admitted by the STS of April 11, 2018, the Communication of the European Commission of september 27, 2019, and Conclusions of Advocate General, allow the consumer the transactional agreement to avoid prosecuting a possible cause of abuse.
