Resumen
La nueva Ley del Registro civil, ha reformado el artículo 30 del Código Civil, relativo a las condiciones del nacimiento a los efectos de otorgamiento de la personalidad jurídica. Los nuevos requisitos establecidos se centran en la necesidad de nacer, esto es que el feto sea desprendido totalmente del seno materno, y que esté vivo. Se eliminan los requisitos de tener figura humana y de viabilidad o prolongamiento de la vida durante 24 horas.
Abstract
The new Civil Registry Act has reformed article 30 of the Civil Code concerning the conditions that must be met at birth in order for a child to qualify for legal personality. The new requirements focus on the need to be born (i.e., the need for the foetus to be completely detached from the mother's womb) and to be alive. The requirements of having a human shape and viability or 24 hours of sustained life are eliminated.
