Resumen
Se analiza la posibilidad, o no, de reanudar el tracto interrumpido a través del procedimiento del expediente de dominio, cuando los promotores del mismo son sucesores o causahabientes del titular registral. Se repasa la doctrina jurisprudencial en torno a este tema, mayoritariamente contraria a admitir ese mecanismo de reanudación, y se examinan los requisitos del tracto interrumpido y de la oportunidad del procedimiento de expediente de dominio, que sólo procede cuando realmente ha existido dicha interrupción.
Abstract
An analysis is given of the possibility or impossibility of resuming a chain of title that has been interrupted by ownership proceedings filed by the successors or assigns of the registered owner. A review is given of case law on this subject, which is, in the main, contrary to admitting a mechanism of this type, and an examination is made of the requirements of the interrupted chain and the propriety of the ownership proceedings, which are in order only when such an interruption has really existed.
