Título

LA PROGRESIVA DESNATURALIZACIÓN DE LAS RELACIONES PATERNO-FILIALES.

Resumen

En el presente trabajo se analiza la situación de las relaciones paterno-filiales a la luz de las noticias que han saltado a los medios de comunicación en los últimos años. El estudio parte de dichas noticias o hechos llamativos para localizar los problemas técnicos que plantean en su resolución al operador jurídico y, finalmente, resaltar los verdaderos conflictos de fondo que golpean a la institución familiar. Se consideran diversos aspectos expresamente recogidos en el Código Civil, como el deber de los padres de velar por sus hijos y de educarlos correctamente (art. 154 CC), el ejercicio de la patria potestad por un menor no emancipado (art. 157 CC), o la capacidad de obrar de los menores de edad (art. 162 CC). Asimismo, en la exposición se tienen presentes distintos fallos de la jurisprudencia menor, así como importantes manifestaciones legislativas que, de forma directa o indirecta, han influido de manera crucial en la distorsión del régimen paterno-filial actual (Ley Orgánica 1/1996, de Protección Jurídica del Menor; Ley Orgánica 1/2004, de Medidas de Protección Integral contra la Violencia de Género; Ley 54/2007, de Adopción Internacional; Ley Orgánica 2/2010, de Salud sexual y reproductiva y de la interrupción voluntaria del embarazo). En conclusión, las alteraciones más notables que se perciben en las relaciones paterno-filiales en la actualidad son las siguientes: a) La tendencia continuada al abandono del estricto ámbito privado y su orientación hacia el control de Derecho Público. b) La pérdida del originario carácter bilateral de la relación, generando en la actualidad exclusivamente deberes a los padres. c) La prioridad absoluta del interés del menor sobre otros hipotéticos intereses en juego. d) La asunción definitiva de la progresiva adquisición de capacidad de obrar del menor (art. 1263.1.º CC versus LO 1/1996). No obstante, en esta evolución reciente de la figura paterno-filial no se deben olvidar las contradicciones en que a menudo incurre el legislador. Contradicciones que, en ocasiones, conducen a resultados llamativos que en nada benefician a las relaciones de futuro entre padres e hijos (por ejemplo, art. 153 CP y 154 CC).

Abstract

This paper looks at the situation of parent/child relations in the light of recent years' headline news. News items and arresting incidents are examined to locate the technical problems their resolution poses to judicial operators and ultimately to highlight the real conflicts at the heart of the problems facing the family as an institution. Diverse aspects expressly addressed in the Civil Code are considered, such as parents' duty to watch over their children and bring them up (CC, art. 154), the exercise of parental authority by an unemancipated minor (CC, art. 157) and underage children's capacity to act (CC, art. 162). Different rulings of minor case law are taken into account, as is important legislation that has directly or indirectly had a crucial influence on the distortion of today's parent/child regime (Constitutional Act 1/1996 on legal protection for minors, Constitutional Act 1/2004 on measures of comprehensive protection against gender violence, Act 54/2007 on international adoption, Constitutional Act 2/2010 on sexual and reproductive health and the voluntary termination of pregnancy). In conclusion, the most noticeable alterations perceived in parent/child relations just now are the following: a) the ongoing tendency to stray away from the strictly private realm and toward control by public law; b) the loss of the relationship's original bilateral nature, such that now only parents have duties; c) the absolute priority of the child's interest over any other hypothetical interests involved; d) the definitive acceptance of underage children's gradual acquisition of the capacity to act (CC, art. 1263.1, vs. CA 1/1996). Nonetheless, in this recent evolution of the parent/child concept, the frequent contradictions of legislators must not be overlooked - contradictions that sometimes lead to striking results that do nothing to benefit future relations between parents and children (e.g., PC, art. 153, and CC, art. 154).
