Resumen
No cabe entender prescrita la acción de responsabilidad prevista en el artículo 35 de la antigua Ley de Cooperativas de 19 de diciembre de 1974, que fijaba un plazo de tres años contra el Director General de la misma por falta de incumplimiento de las obligaciones legales y estatutarias que le imponía garantizar mediante aval bancario o contrato de seguro la devolución de las cantidades anticipadas por los cooperativistas al entenderse que el plazo estaba interrumpido por seguirse un proceso penal, pero no contra los demás miembros del Consejo Rector para quienes la prescripción si juega.
Abstract
Action for liability under article 35 of the former Act of 19 December 1974 on Cooperatives cannot be held to be limited. The act set a three-year term during which action could be taken against the general manager of a cooperative for failure to discharge the obligations that, by law and other rules, the general manager was obliged to secure with a bank guarantee or insurance policy ensuring the reimbursement of the sums paid in advance by the members of the cooperative when the term was deemed to have been interrupted due to a criminal process, but not against the other members of the Governing Board, for whom limitation of action did apply.
