Resumen
La “okupación” de inmuebles es un fenómeno actual y preocupante en nuestro país, pues permite la posesión de inmuebles de forma ilegítima frente a su propietario. El gran crecimiento de este fenómeno en los últimos años nos hace plantearnos qué es realmente desde el punto de vista jurídico, cuál es la naturaleza de los derechos confrontados en él, y como consecuencia de esto, cuáles son los medios de defensa de cada uno de los sujetos intervinientes, para tratar de averiguar cuál debe prevalecer. En este trabajo se analizarán estas cuestiones, solo desde el punto de vista del Derecho civil, tratando de arrojar luz a un fenómeno posesorio que, en teoría, no debería prevalecer sobre el derecho de propiedad, ni aunque se aduzca para su defensa el derecho a una vivienda digna.
Abstract
The squatting of real estate is a current and worrying phenomenon in our country, since it allows the possession of real estate in an illegitimate way in front of its owner. The great growth of this phenomenon in recent years makes us wonder what this phenomenon really is from the legal point of view, what is the nature of the rights confronted in it, and as a consequence of this, what are the means of defense of each one of the intervening subjects, to try to find out which one should prevail. In this work these issues will be analyzed, trying to shed light on a possessory phenomenon that should not have any further legal protection.
