Resumen
El enriquecimiento injusto o sin causa tiene en nuestro ordenamiento jurídico la significación de principio general de Derecho aplicable como fuente subsidiaria y además la de ser una institución jurídica que mantiene que nadie debe enriquecerse sin causa o a costa de otro. Esta norma ha perdurado a lo largo de los tiempos en nuestro país y, si bien es cierto que no se regula con profundidad en un artículo concreto de nuestro Código Civil, su finalidad se recoge en muchísimas instituciones contenidas en dicho cuerpo legal y en otras leyes.
Abstract
Unjust enrichment holds, in our law, the standing of a general principle of law that is applicable as a subsidiary source, and also the standing of a legal institution that maintains that no-one should gain enrichment without cause or at the cost of another.
This rule is longstanding in our country and, although it is true that unjust enrichment is not thoroughly regulated in a specific article of our civil code, its purport is addressed in a vast number of institutions contained in said legal body and in other laws.
