Resumen
Las fundaciones realizan una gran labor en nuestra sociedad. Su constitución depende de la voluntad de un fundador. Voluntad que se plasma en los estatutos fundacionales debiendo establecer un fin fundacional, acorde a esa voluntad pero también a la ley. La determinación del fin fundacional y su cumplimiento permite la existencia de la fundación siempre que no se individualicen sus beneficiarios, por eso se trata de averiguar si solo las colectividades genéricas de personas son los beneficiarios de los fines fundacionales.
Abstract
The foundations do a great job in our society. Its constitution depends on the will of a founder. Will that is embodied in the founding statutes must establish a foundational purpose, according to that will but also to the law. The determination of the foundational purpose and its fulfillment allows the existence of the foundation provided that its beneficiaries are not identified, that is why it is a matter of ascertaining if only the generic collectivities of persons are the beneficiaries of the foundational purposes.
