Resumen
La poligamia no es simplemente algo contrario a la legislación española, sino algo que repugna al orden público español, que constituye siempre un límite infranqueable a la eficacia del derecho extranjero (art. 12.3 CC). Es perfectamente ajustado a derecho que la Administración española considere que alguien cuyo estado civil es atentatorio contra el orden público español no ha acreditado un «suficiente grado de integración en la sociedad española».
Abstract
Polygamy is not just contrary to Spanish legislation. It is repugnant to Spain's public order, and the public order always constitutes an insurmountable constraint on the efficacy of foreign law (Civil Code, art. 12.3). It is perfectly lawful for the Spanish authorities to regard someone whose marital status constitutes an attack on the public order in Spain not to have accredited «a sufficient degree of integration into Spanish society».
