Resumen
El presente artículo se adentra en las funciones mediadora y de justicia entre los acreedores propias de las instituciones concursales, ofreciendo un trato paritario a los mismos en similares circunstancias ante la concurrencia crediticia adherente a toda situación de insolvencia. Se estudia en particular cómo dicho ideal se realizaba en el anterior y en el actual régimen concursal. En dicho análisis se puede entrever la parcial cesión de dicha primacía de la par condicio creditorum a nuevos condicionantes introducidos por el actual sistema concursal. El artículo cierra con una firme exhortación a perpetuar la justicia entre los acreedores como el utillaje y la herramienta más a propósito para apuntalar la protección del crédito y el fortalecimiento de la inversión en nuestro sistema legal.
Abstract
This article focuses on the role of legal bankruptcy institution to promote the enforcement of both, mediation and justice among creditors. It tries to achieve an equal treatment to creditors in similar. In particular, this piece of work deals with both former and current Spanish insolvency procedure. In this analysis, it is possible the loss of primacy of the par condicio creditorum towards new values introduced by the new insolvency act. The article concludes with a strong call to preserve a just treatment among creditors as tool to strength both the uphold of the credit and the protection of investments.
