LA INSCRIPCIÓN SEPARADA DEL SUELO Y DEL SUBSUELO Y LA NUEVA REGULACIÓN DE LA LEY 8/2007, DE SUELO ESTATAL, Y SU TEXTO REFUNDIDO APROBADO POR EL REAL DECRETO-LEY 2/2008: COMENTARIO A LA DOCTRINA DE LA DIRECCIÓN GENERAL DE LOS REGISTROS Y DEL NOTARIADO EN RELACIÓN CON EL ARTÍCULO 17 DE LAS CITADAS LEYES.

Resumen
La Dirección General de los Registros y del Notariado ha aceptado la inscripción separada del suelo y el subsuelo, incluso cuando pertenecieran a un régimen jurídico público en un caso y privado en el otro, siempre dentro del marco de la relación estatutaria propia de los complejos o conjuntos inmobiliarios. Otras alternativas se contemplan, no obstante, como hipótesis en la Resolución de 27 de febrero de 2007. La Ley 8/2007, de 28 de mayo, de Suelo estatal, redefinió los conceptos de finca y parcela y determina cuándo se puede constituir un complejo inmobiliario partiendo de la superposición de propiedades públicas y privadas. En nuestra opinión, el nuevo régimen jurídico es conforme con la doctrina de la Dirección General, en cuanto ésta exige interdependencia de los folios registrales destinados a publicar los derechos sobre el suelo y el subsuelo; otra interpretación impediría el acceso al Registro de la Propiedad de los derechos constituidos.
Abstract
The Directorate-General of Registries and Notarial Affairs has accepted the registration of land and subsoil separately, even when one falls under a public legal framework and the other, a private legal framework, provided that they are combined in the characteristic relationship established by the by-laws of real-estate complexes or developments. Other alternatives are envisaged, however, as hypotheses in the Decision of 27 February 2007. Act 8/2007 of 28 May on state land redefined the concepts of «a property» and «a lot» and determined when a realestate complex can be created in a situation where public and private ownership are superimposed. In our opinion the new legal framework agrees with the doctrine of the Directorate- General, inasmuch as the latter demands interdependence of the registration folios where the rights in the land and subsoil are to be published; any other interpretation would hamper access to registration of the rights created in this process.
