Resumen
La finalidad de la pensión compensatoria es colocar al cónyuge perjudicado por la ruptura del vínculo matrimonial en una situación de potencial igualdad de oportunidades a la que habría tenido de no haber mediado tal matrimonio, por ello se hace necesario tener en cuenta las circunstancias sobrevenidas tras la ruptura que reequilibran su situación. Las circunstancias sobrevenidas que supongan el paso de una situación de desequilibrio a un aumento del nivel económico en el cónyuge desfavorecido, posibilitan la necesaria extinción de la pensión, por su propio fundamento, aunque no esté explícitamente señalado en el Código Civil. El hecho de recibir una herencia es una circunstancia en principio no previsible, sino sobrevenida, susceptible de incidir favorablemente en la situación económica del beneficiario o acreedor de la pensión, y, como tal, determinante de su modificación o extinción. No obstante, puede que no extinga la pensión compensatoria, pero puede reducirla.
Abstract

The supervening circumstances that suppose the passage of a situation of imbalance to an increase of the economic level in the disadvantaged spouse, make possible the necessary extinction of the pension, by its own foundation, although it is not explicitly indicated in the Civil Code. The fact of receiving an inheritance is a circumstance that, in principle, is not foreseeable, but unexpected, capable of favorably influencing the economic situation of the beneficiary or creditor of the pension, and, as such, determining its modification or extinction. However, it may not extinguish the compensatory pension, but it can reduce it.
