Resumen
En este estudio se analizan las especialidades procesales que emergen cuando una de las partes en litigio es una herencia yacente. Partiendo del reconocimiento formal de la capacidad procesal de la herencia yacente en el artículo 6.1.4o de la LEC y admitida por la jurisprudencia desde mediados del siglo XX, nos adentramos en las concretas dificultades jurídicas y fácticas que comporta el hecho de que esa aptitud subjetiva carezca de desarrollo más allá del artículo 6.1.4o LEC y de la ambigua previsión que incluye después el artículo 7.5 LEC. Desde la complejidad procesal que puede comportar la duda sobre si el demandado vive o ha fallecido, y su patrimonio se encuentra provisionalmente sin titular, ya sea antes del proceso, durante el mismo o en el momento de ejecutar, al cumulo de cautelas que deben tomarse para evitar que por apreciar el órgano judicial indicios de indefensión para los futuros destinatarios de esa herencia yacente el proceso seguido sea inútil. Como complemento a lo anterior, y vinculado también a ese riesgo de indefensión, se aborda el examen de la doctrina de la Dirección General de los Registros y del Notariado sobre inscripciones y anotaciones derivadas de un litigio y relativas a bienes integrados en una herencia yacente.
Abstract
This study analyzes the substantive and procedural issues that emerge when one of the parties in litigation is a «vacant or unclaimed inheritance». We revise the specific legal and factual difficulties of a suit in which a vacant inheritance is involved, taking as the starting point the formal recognition of its passive procedural standing in article 6.1.4º LEC, previously admitted by the courts. These difficulties are due, mainly, to the ambiguity of this legal recognition and its lack of development beyond articles 6.1.4º and 7.5 LEC. We first address the procedural complexity that may involve the question of whether the defendant lives or not, and his estate is provisionally without a person who has title, either before the trial, during or at the time of enforcing the judgment. Then we analyze the set of measures that are necessary for our courts so as to not cause a lack of defenses to the future owners of the vacant inheritance (the heirs), because that could cause the invalidity of judicial proceedings. Finally, we examine the doctrine of the D.G.R.N. concerning the registrations resulting from judicial decisions over real property integrated into a vacant inheritance.
