Resumen
El objetivo de este comentario es determinar, a la luz de los pronunciamientos jurisprudenciales sobre la materia, los supuestos en los que la agencia de viajes, en los contratos de reserva de plazas de alojamiento en régimen de contingente, asume una obligación de resultado y, en consecuencia, «garantiza » la ocupación efectiva de las plazas reservadas. Un aspecto sobre el que se incidirá especialmente es el relativo al fundamento jurídico de esta «garantía », lo que nos llevará inevitablemente a abordar el tema de la naturaleza jurídica del contrato.
Abstract
The object of this commentary is to determine, in the light of case law on the matter, the cases where a travel agency, in contracts reserving accommodations under a contingent scheme, assumes an obligation to provide a result and consequently «guarantees» actual occupation of the reserved accommodation slots. One point on which special emphasis shall be laid is the legal grounds for this «guarantee», which will lead inevitably to the topic of the legal nature of the contract.
