Resumen
La fianza general es una garantía personal en la que el garante responde de las deudas presentes y futuras que el deudor principal asume con un acreedor habitualmente sin limitar el tiempo ni la cuantía de las operaciones garantizadas. Los elementos que estructuran el contrato de fianza general presentan peculiaridades propias que deben ajustarse al tratamiento positivo de la fianza que dispone el ordenamiento civil. Ello ha generado sucesivas cuestiones y dificultades de concordancia, especialmente cuando se formaliza en un contrato de adhesión junto al negocio jurídico principal, en suma, variados problemas que la jurisprudencia ha ido resolviendo parcialmente y sin llegar a afrontar una doctrina unificada de la configuración integral de la fianza general que, para su consolidación futura, debería tener una pronta respuesta legislativa.
Abstract
The general guarantee is a personal guarantee in which the guarantor is responsible for present and future debts that the main debtor usually assumes with a creditor without limiting the time or amount of the guaranteed operations. The elements that structure the general security contract have their own peculiarities that must be adjusted to the positive treatment of the bond provided by civil law. This has raised successive questions and difficulties, especially when it is formalized in an adhesion contract together with the main legal business. In short, there are various problems that the jurisprudence has been partially resolving without addressing a unified doctrine of the integral configuration of the general guarantee that, for its future consolidation, should have a prompt legislative response.
