LA DINÁMICA DEL DERECHO Y SU APLICACIÓN MECÁNICA.

Resumen

Este trabajo intenta reflejar los presuntos antecedentes técnico-mecanicistas de los Sistemas Registrales de gran desarrollo técnico-jurídico que surgieron en la Europa continental en la segunda mitad del siglo XIX, cuando los estudios ilustrados de la época rememoran los avances de la Filosofía Natural surgida en los siglos anteriores (XVI y XVII) y que en el mundo jurídico cristalizan en leyes especiales complementarias de los Códigos Civiles estandarizados en su regulación de la propiedad «estática» (modelo napoleónico), cuya reforma era insistentemente demandada por la evolución de las sociedades avanzadas para regular y propulsar la «dinámica» del Derecho en una época caracterizada por el intenso movimiento de sus elementos reales y personales, actualmente radicalizado por la masificación y la globalización de la economía mundial. Como consecuencia, el hombre actual se ve envuelto en múltiples ficciones favorecidas por la publicidad como medio de difusión de esa red simbólica que domina la vida real y que puede dar lugar a una vida «oficial» a veces distinta. Según BENTHAM, el orden jurídico que impone una vida «oficial», diferente a veces de la real, no es más que un «mecanismo» de ajuste de intereses para proporcionar seguridad como garantía de la libertad, mediante la necesaria conciliación de los derechos individuales y los generales o comunes. En las sociedades modernas es evidente que la seguridad depende de la publicidad que elimina los riesgos de la clandestinidad. Pero no basta cualquier Registro. Los Registros jurídicos de corte germánico y de gran desarrollo técnico priman sobre los demás, y actualmente se complementan con un avanzado mecanicismo utilitario del que resulta que la publicidad registral, por sí sola, puede ser apreciada como una forma de «autenticación mecánica» cuando es precedida de una rigurosa depuración, profesional y responsable, de los actos inscribibles en cuanto a su legalidad y al formalismo impuesto como garantía de esa seguridad: Es la calificación de los Registradores de la Propiedad, que, en acertada simbiosis de un juicio racional y una mecánica publicitaria, permite atribuir a los derechos proclamados en los asientos el valor que se deriva del principio de fe pública, amparado por una tutela judicial que recoge la Constitución.

Abstract

This paper attempts to reflect the supposed technical/mechanicist background of the highly technically and legally developed registration systems that arose in continental Europe in the second half of the nineteenth century. The illustrated studies of the era used to mull over the advances of the Natural Philosophy that sprang up in earlier centuries (the 16th and 17th). In the legal world, those advances crystallised into special laws supplementing the civil codes that had a standardised regulation of «static» property (Napoleonic model). Reform of those civil codes was insistently demanded by the evolution of advanced societies, in order to regulate and propel the «dynamics» of law in an era characterised by the intense movement of its real and personal elements, currently radicalised by the massification and globalisation of the world economy. As a consequence, today's man is embroiled in multiple fictions favoured by publicity as a means of disseminating that symbolic network that dominates real life and that can give rise to an «official» life that is sometimes different. According to BENTHAM, the legal order that an «official» life imposes, which is sometimes different from real life, is no more than an interest- adjusting «mechanism» to provide security as a guarantee of freedom by means of the necessary reconciliation of individual rights and general or common rights. In modern societies it is clear that security depends on publicity, which eliminates the risks of clandestineness. But not any registry will do. Germanic-style, highly technically developed registries of rights stand head and shoulders above the rest, and nowadays they are complemented by an advanced utilitarian mechanicism, one result of which is that registration publicity by itself can be appreciated as a form of «mechanical authentication» when it is preceded by a strict, professional, responsible examination of registrable acts for legality and the formalism imposed to guarantee document certainty: This is scrutiny by property registrars, which, in a cunning symbiosis with rational judgement and publicity mechanics, enables the rights proclaimed in registration entries to be accorded the value that stems from the principle of registrar-attested authenticity, supported by constitutional legal protection.
