Resumen
Frente a la regla general de la necesaria acreditación en las escrituras de declaración de obra nueva de la constitución del seguro de diez años previsto en la legislación sobre ordenación de la edificación, se alza como excepción el supuesto de que la construcción sea destinada a vivienda propia del promotor. En este comentario se realiza un acercamiento a los requisitos necesarios para que opere esta exención legal.
Abstract
The general rule is that deeds declaring new construction must accredit that the ten-year insurance policy called for in building legislation has been taken. The case where the construction is intended as the developer's own home stands as an exception to this general rule. This commentary addresses the requirements necessary in order for this legal exemption to function.
