Resumen
El presente artículo versa sobre la controversia creada por la promulgación por la Sala Penal del Tribunal Supremo de la Sentencia 607/2020 de 13 de noviembre y la declaración en la misma, de que la responsabilidad civil derivada de una condena penal firme no prescribe hasta la completa satisfacción de la obligación civil. En este sentido, el Tribunal Supremo ha priorizado la reparación completa de la víctima y ha valorado las complejidades que existen en el proceso penal, para inaplicar el instituto de la prescripción extintiva.
Abstract
This article deals with the controversy created by the promulgation by the Criminal Chamber of the Supreme Court of Judgment 607/2020 of November 13 and the declaration therein, that the civil liability derived from a final criminal conviction does not prescribe until the complete satisfaction of the civil obligation. In this sense, the Supreme Court has prioritized the complete reparation of the victim and has assessed the complexities that exist in the criminal process, in order to not apply the institute of extinctive prescription.
