Resumen
Hasta la actualidad en la tradicional permuta de solar a cambio de obra futura, la inclusión de un pacto con inclusión de la condición resolutoria expresa, para el caso de falta de cumplimiento de la prestación por parte de cesionario, ha sido una fórmula, ágil y eficaz para garantizar a quien se ve desprovisto de su propiedad sin obtener al menos inicialmente, la prestación que le es debida en cambio. No obstante, la tradicional permuta, se ha visto superada por otras fórmulas que permiten una mayor flexibilidad y margen de negociación entre las partes, como la cesión de solar, o la aportación y puesta común. Sin embargo proponemos de nuevo la fórmula de la cesión del aprovechamiento urbanístico, que es perfectamente asimilable, y entendemos puede ser muy eficaz para la finalidad a la que se orienta en este contrato, pudiendo garantizarse igualmente con la condición resolutoria expresa.
Abstract
Up to the present in the traditional exchange of solar in exchange for future work, the inclusion of a pact including the condition resolutory expresses, in the case of non-compliance with the provision by the transferee, has been a formula, agile and effective to guarantee those who are deprived of their property without obtaining at least initially, the benefit that is due in exchange. However, the traditional swap has been overtaken by other formulas that allow greater flexibility and negotiation margin between the parties, such as the transfer of land, or common input and sharing. However, we propose again the formula of the cession of the urban development, which is perfectly assimilable, and we understand it can be very effective for the purpose to which it is oriented in this contract, being able to be guaranteed also with the express resolutory condition.
