Resumen
La Ley Hipotecaria española reconoce a los notarios y registrado- res legitimación para impugnar las resoluciones de la DGRN ante los tribunales civiles, siempre y cuando lo hagan en defensa de un derecho o interés del que ellos mismos sean titulares. al mismo tiempo, excluye la legitimación de las corporaciones profesionales de notarios y registradores para entablar esta clase de procedimientos. en los últimos años se han producido numerosos pronunciamientos jurisprudenciales acerca de esta cuestión, motivados principalmente por la ambigüedad y la falta de claridad de la norma. el objeto de este trabajo es hacer una revisión crítica de la jurisprudencia recaída hasta la fecha sobre el particular, a la luz de los rasgos definitorios del sistema español de seguridad jurídica preventiva en el tráfico inmobiliario.
Abstract
The Spanish Mortgage Law grants standing to challenge the deci sions of the DGRN before the civil courts to notaries and registrars, as long as they do so in defense of a right or interest of their own. At the same time, it excludes the standing of the professional corporations of notaries and registrars to engage in these proceedings. In recent years there have been numerous jurisprudential pro nouncements on this issue, mainly motivated by the ambiguity and lack of clarity of the legal provisions on the matter. The purpose of this paper is to make a critical review of the existing case law on the subject, in light of the defining features of the Spanish system of preventive legal security in real estate transactions
