Resumen
La sentencia del Tribunal Supremo, de 21 de diciembre de 2009, trata la cuestión de la causa subjetiva o motivos incorporados a la causa del contrato en un contrato de compraventa de la totalidad de acciones de una sociedad anónima, cuyo activo principal era un hotel con aluminosis. En este trabajo se lleva a cabo una valoración de los argumentos de dicha sentencia en relación con la referida causa subjetiva y sobre el objeto del mencionado contrato.
Abstract
The Supreme Court's ruling of 21 December 2009 deals with the issue of the subjective cause or motives incorporated in the cause of a contract to purchase all shares in a corporation whose primary asset was a hotel built with high-alumina cement concrete.
This paper evaluates the arguments in the said ruling in connection with the aforesaid subjective cause and the object of the aforementioned contract.
