Análisis comparativo de diversas sentencias del Tribunal Supremo en las que se trata el tema de la captación de la voluntad del testador que constituye una modalidad de dolo, siendo una cuestión de hecho que ha de ser probada por quien la invoca. Ha de valorarse la capacidad del testador al tiempo del otorgamiento del testamento.
Alcance de la fe notarial en esta materia.
Abstract
Comparative analysis of a number of Supreme Court rulings addressing the issue of capturing the wish of the testator when it constitutes a mode of wilful wrongdoing, this being a question of fact that must be proved by the claimant. The testator's capacity must be evaluated at the time the will is made. Scope of the notary's power to attest documents in this matter.
