Resumen
Este artículo presenta un análisis en el contexto cubano sobre la anotación en sede de propiedad industrial, a la luz de nuevas regulaciones, así como los efectos jurídicos que producen. También es objetivo del presente, examinar las cláusulas abusivas en los contratos de licencias de propiedad industrial, como una condición que impide la anotación de estos contratos, en la revisión de fondo que realiza la autoridad competente nacional durante el procedimiento de anotación. Asimismo, con relación a la anotación de los contratos de licencia de patente y de marca, se identifican desde la perspectiva comparada sistemas obligatorios, facultativos u opcionales de anotación.
Abstract
This article presents an analysis in the Cuban context about the annotation in industrial property field, in light of new regulations, as well as the legal effects they produce. It is also the objective of the present, to examine the abusive clauses in the contracts of licenses of industrial property, as a condition that prevents the annotation of these contracts, in the review of the background made by the national competent authority during the annotation procedure. Likewise, in relation to the annotation of the patent and trademark license contracts, mandatory or optional annotation systems are identified from the comparative perspective.
